SALARY RANGE/GRADE: Excepted Service, ES8 ($92,742 - $139,113)
The position will serve as General Counsel to the Office of the Deputy Mayor for Greater Economic Opportunity (DMGEO). The incumbent will assist in ensuring that its programs conform with District law, serving as FOIA officer for the DMGEO, and helping all the agencies and commissions reporting to the DMGEO meet the highest ethical standards and legal compliance. Agencies and commissions reporting to the DMGEO include: the Department of Employment Services, the Department of Small and Local Business Development, the Office of African American Affairs, the Commission on Fathers, Men, and Boys and the Workforce Investment Council.
DUTIES AND RESPONSIBILITIES
- Conducts legal research and prepares memoranda on ethics issues, including conflicts of interest, acceptance of invitations, outside employment and other Code of Conduct matters, as well as the local Hatch Act, and provides routine advice.
- Serves as the ethics officer for the DMGEO.
- Provides research, opinions and advice to the DMGEO regarding possible fraud, waste, abuse, and mismanagement and if and when credible allegations of such arise, makes referrals as necessary to the Office of Inspector General.
- Advises the DMGEO and her staff on legal and policy matters related to legislation and regulations and works with DMGEO and the Office of Policy and Legislative Affairs (OPLA) to make sure new initiatives relating to the Mayor’s goals for inclusive prosperity are drafted properly, noticed in accordance with the Administrative Procedures Act and Council rules, and are legally sound, preparing a lead role in drafting as requested.
- Analyzes existing and proposed Federal and local legislation and regulations relating to DMGEO programs.
- Coordinates and facilitates DMGEO responses to the various committees of the Council in conjunction with OPLA.
- Advises the DMGEO when new legislation requires rulemaking and provides technical assistance and advice in rule development.
- Maintains a repository of laws, regulations, policy issuances and judicial and administrative law opinions relating to the work of the DMGEO.
- Interprets and analyzes judicial and administrative decisions of the District of Columbia and Federal Government to assure legislative and regulatory compliance and conformity with those decisions, and initiate necessary revisions in laws and regulations.
- Provides legal advice concerning DMGEO programs and activities.
- Seeks opinions from, and coordinates on litigation with the Office of the Attorney General, through the Mayor's Office of Legal Counsel (MOLC) on matters relating to the DMGEO.
- Ensures that any procurements or grant programs are conducted in conformity with District and applicable federal law.
- Drafts and/or reviews any grant agreement or Memoranda of Agreement or Understanding involving the DMGEO.
- Serves as liaison to the Office of Risk Management in regards to matters involving insurance, workers compensation, and tort liability.
- May be called upon to conduct internal investigations, interview persons, and prepare responses or form judgments and recommendations.
- Works with the Mayor’s Office of Talent and Appointments (MOTA) and/or the DC Department of Human Resources (DCHR) to ensure that any hiring or other personnel actions taken at the DMGEO are in conformance with the D.C. Code and D.C. Municipal Regulations.
- Develops draft responses to any audits or investigations relating to the DMGEO.
- Serves as the Freedom of Information Act (FOIA) officer for the DMGEO and develops technical expertise in FOIAXpress or whatever system is then in use.
- Serves as Language Access Coordinator for the DMGEO.
- Tracking any outstanding legal issues raised by the OAG, Council, the Inspector General, BEGA, the Auditor, the Office of Human Rights, or administrative or judicial rulings, relating to OAG, as relates to DMGEO, and ensuring they are resolved satisfactorily.
- Performs other duties as assigned.
REQUIRED BACKGROUND AND EXPERIENCE
- Must be an attorney barred in the District of Columbia, or have the ability to waive in within 360 days of appointment.
- Minimum of 1-5 years experience providing guidance/legal advice at senior level.
- Knowledge of the District of Columbia government.
- Knowledge of and adherence to applicable ethical standards.
- Ability to learn about and understand the goals of the programs under the ambit of the DMGEO.
- Knowledge of and an ability to interpret Department policies and procedures, Mayor's Orders, and District or Federal laws and regulations on matters within the compass of the DMGEO, including job training, economic development, and equity.
- Knowledge and skill to prepare clear and concise reports, position papers, studies and legal analyses of legislative, regulatory, contracting and other legal matters on their effect upon various programs within the Department with minimal supervision.
- Knowledge and ability to conduct extensive legal research in connection with legal questions concerning the interpretation and application of statutes, rules and regulations, and skill in the analysis and resolution of complex issues.
- Ability to spot and mitigate risks while supporting program objectives.
- Skill in communicating precisely and efficiently, both orally and in writing.
- Organization and an ability to meet deadlines.
There is a legal requirement that each new appointee to the Excepted and Executive Service either: (1) be domiciled in the District of Columbia at the time of appointment; or (2) establish District domicile within one hundred eighty (180) days of appointment. The law also requires that Excepted and Executive Service employees maintain District domicile during the period of the appointment. Failure to maintain District domicile during the period of the appointment will result in forfeiture of employment.
